New Legislation in Egypt Champions Workplace Equality for Women

The proposed new labor law presented by the government to the House of Representatives encompasses several benefits and guarantees aimed at safeguarding women working in the private sector. The government emphasizes its commitment to granting women their rights and encouraging their participation in the workforce.

The "Women's Employment" section of the labor law outlines assurances and gains for working women as follows:

All regulations governing workers' employment apply equally to female workers, without discrimination, when their work conditions align.

The competent minister, in consultation with the National Women's Council and the National Council for Childhood and Motherhood, will issue a decision specifying conditions, occasions, times, and tasks where women cannot be employed.

Female workers have the right to maternity leave for four months, covering the period before and after childbirth. The post-childbirth leave should not be less than 45 days, is fully paid, and cannot be granted more than twice during their employment.

It is prohibited to terminate the employment of a female worker or end her service during maternity leave.

Employers are prohibited from withholding compensation for the worker's salary that they are obligated to pay for the duration of maternity leave. If it is proven that the female worker worked for others during her leave, the employer can reclaim the paid amount without interfering with disciplinary accountability.

A breastfeeding female worker is entitled to two additional breaks, each not less than half an hour, within the two years following childbirth, in addition to the regular break. These additional breaks are counted as working hours and do not result in any reduction in pay.

A female worker in an establishment employing 25 or more workers has the right to unpaid leave for up to two years to care for her child. This leave cannot be granted more than three times during her employment.

A female worker has the right to terminate her employment contract due to marriage, pregnancy, or childbirth, provided she notifies the employer in writing within three months of the marriage contract, the pregnancy confirmation, or the childbirth, depending on the circumstances.

Employers must display a copy of the women's employment system in the workplace or where workers gather.

Employers employing one hundred or more female workers in one place must establish a nursery or entrust a nursery to care for the children of female workers, following conditions specified by the competent minister.
